These Terms & Conditions govern access to and use of fendrixcloud.com. They apply to the website itself and do not replace a signed services agreement, statement of work, order form, nondisclosure agreement, or other project-specific contract. If a signed agreement conflicts with these website terms regarding paid services, the signed agreement controls for that engagement.

1. Website Use

You may use the website for lawful business purposes, including reviewing service information and submitting a project inquiry. You may not interfere with website operation, probe systems without authorization, attempt to bypass security controls, introduce malicious code, scrape the site in a manner that harms service availability, impersonate another person, or use the website to violate law or third-party rights.

2. Informational Content

Website content describes general capabilities, service categories, and starting prices. It is not a binding proposal, fixed quote, technical specification, guarantee of availability, or promise that any particular architecture, tool, framework, AI model, cloud provider, delivery method, or timeline will be used for a future project.

3. Starting Prices

Prices shown on the website are starting points for planning purposes. Actual fees depend on scope, complexity, product requirements, integrations, infrastructure, security needs, data migration, testing, project management, timeline, support obligations, and other factors. A project is not accepted until the parties agree to the applicable commercial terms in writing.

4. Intellectual Property

The website design, original written content, brand elements, and other materials owned by Fendrix Cloud are protected by applicable intellectual-property laws. You may review the site for normal business purposes but may not reproduce substantial portions for commercial reuse without permission. Ownership of project deliverables is determined by the applicable signed services agreement and payment status, not by these website terms alone.

5. Third-Party Services

The website or future project work may reference cloud providers, software libraries, platforms, APIs, AI services, payment systems, or other third-party products. Third-party services are governed by their own terms, pricing, availability, security practices, and technical limitations. References do not imply sponsorship or a guarantee of third-party performance.

6. No Unauthorized Access

You may not use the website or any provided demonstration, test environment, endpoint, or account to gain unauthorized access to systems or data. Security testing, scanning, reverse engineering, or load testing requires prior written authorization when applicable.

7. Disclaimer of Website Warranties

The website is provided on an as-available basis for general business information. To the extent permitted by law, Fendrix Cloud disclaims implied warranties relating to the website, including merchantability, fitness for a particular purpose, and non-infringement. This clause does not override express warranties, if any, contained in a signed project agreement.

8. Limitation of Website Liability

To the extent permitted by law, Fendrix Cloud is not liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of or inability to use the public website. Liability relating to paid services is governed by the applicable services agreement.

9. Changes and Availability

We may update, reorganize, suspend, or discontinue website content or features. Service descriptions and starting prices may also change. The version visible when you review the site may differ from earlier versions.

10. Governing Framework

These website terms are intended for a US-based business. Applicable law and dispute provisions for paid client engagements should be set out in the signed agreement for the specific project. Nothing in these terms eliminates rights that cannot legally be waived.
